Rolus Beverages, Inc. ("Rolus", “we” or “us”) is committed to protecting the personal information of the visitors to its websites, purchasers of its products, and other individuals whose personal information it may collect and process (“you”).

We want you to understand how we use your personal information when you use our Services, which are described below. In addition, we want to be sure that you understand your rights and choices with respect to your personal information and how we use it. How we handle information about you depends on which Services you use and how you use them, so not all of the information in this privacy policy may apply to you. 

The Scope of this Privacy Policy

This Privacy Policy describes Rolus’ practices for collecting, using, maintaining, protecting, and disclosing (“processing”) your personal information when you use our services (“Services”), such as when you: 

  • Visit a website of ours that links to this Privacy Policy (collectively, our “Websites”), including rolus.com
  • Subscribe to or engage with our newsletters or other electronic communications
  • Interact with our social media pages
  • Click on our ads posted on third party sites
  • Communicate with our service representatives or features (including via chat functions, email, text, or phone)
  • Use our Services anywhere we collect information from you and refer to this Privacy Policy

This Privacy Policy also applies to personal information we collect from third parties about you.

Our privacy practices are subject to the applicable laws of the places in which we do business, so we have added region-specific terms that only apply to customers located in certain geographic regions, or as required by applicable laws. 

This Privacy Policy does not apply to: 

  • Provide a clear purpose, agenda, and desired outcome with the invite Third-Party Sites and Services. This Privacy Policy applies to personal information we collect from third parties about you, but we do not control the privacy and personal information handling practices of third parties. Therefore, this Privacy Policy does not apply to websites, apps, videos (embedded or direct links), or other content (each a “Linked Site”) to which we link that are not operated by Rolus. Linked Sites have their own personal information collection and use practices, and we are not responsible those practices. We encourage you to read each Linked Site’s privacy disclosures to understand how your personal information is processed.
  • Workforce Members and Candidates. Our processing of the personal information of current or former workforce members and job applicants is not governed by this policy.
  • Non-Personal Information. Our processing of information that cannot be linked to an identifiable or identified individual, including non-identifying aggregate information. We may process this data for any legitimate business purpose.

Updates to Our Privacy Policy

We may update this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the Policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access our Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

Children’s Privacy

Our Services are not intended for persons under 16 years of age. We do not knowingly collect or process the personal information of individuals under the age of 16. If we learn that we have collected personal information from a child under age 16, we will delete that information as quickly as possible. If you believe that a child under 16 may have provided us their personal information, please contact us at support@rolus.com. 

Information We Collect and How We Collect It

The information we gather about you will vary and depend on our relationship with you. The following describes how we process personal information about you in various contexts. 

Information We Gather Through Our Online Services

Our “Online Services” include our Websites, as well as our electronic communication services like email and electronic messaging, and our social media pages (though not the platforms on which they are maintained). When you use our Online Services, we collect some information automatically and combine it with other information we collect about you. In many cases we utilize third parties to assist with this collection. In such cases, your personal information is made available to other entities for processing on our behalf or at our direction. 

Some of this information is collected and logged as a result of your access to our servers, but we also collect it using various technologies such as cookies, web beacons, scripts, tags, and other software code that store and transmit personal and other information (collectively “Data Gathering Technologies”). You can read more about our Data Gathering Technologies in our Cookie Notice. Some of these Data Gathering Technologies are used by third-parties to collect or receive information from the Online Services and elsewhere on the Internet and use that information to provide measurement services and target ads. The categories of personal information we collect automatically through our Online Services include: 

  • Device Identifiers. Certain information about the devices you use to access our Online Services are automatically logged and associated with identifiers that may be unique to your device. The information includes IP address, cookie identifiers, operating and browser information, language preferences, device identifiers, and advertising IDs.
  • Device Characteristics. Device characteristics are signals about a customer’s browser, screen, or device.
  • Using Data Gathering Technologies and logs, we collect information about how you use our Online Services. This information includes, for example, the pages you visit, when you visit them, and how long you stay on them, the buttons you click, your movements (including mouse or cursor movements) through the Websites, the media (including videos) you watch through our Online Services, whether you open an email, the content you view, the keystrokes and information you type into form boxes or other spaces on the Websites, and your electronic communications with us using our Online Services. 
  • Location information. When you visit our Online Services, we can determine or infer your locations, including sometimes your precise geolocation. For example, we infer your general geolocation using your IP address. If you provide or allow us to access additional information related to your location, such as by inputting your address or allowing us to access the precise location of your device, we will collect this information as well. Precise geolocation is considered sensitive personal information in some jurisdictions. 
  • Advertising Metrics. Information about the advertisements you have viewed on our Websites and whether you have interacted with our ads on other websites or digital properties. 

Information You Voluntarily Provide to Us. 

Information that you directly submit to use through our Services may include:

Contact Information. Contact information includes your name, mailing/shipping address, email address, telephone number, account name, social media handle, and similar information. We collect this in various contexts, including when you request information, engage in a transaction, register for an account, communicate with us, or otherwise interact with us.

Commercial Transaction Information. We maintain records of commercial information related to our Services, including products purchased or considered from Rolus or others, as well as your purchasing or consuming history and tendencies. 

Billing and Payment Information. To process payments and facilitate transactions, we collect and use your payment information. This can include your Contact Information along with your credit or debit card information and any other relevant information.

Personal Characteristics. Using the information we gather about you, we may infer characteristics about you pertaining to your personal preferences (such as your taste in beverages or other products you may enjoy), your characteristics (such as your buying power) and your behavior. We maintain this information to provide more tailored services to you and to present you with content, communications, and choices that are relevant to you. 

Records of Interactions. We collect personal information about your interactions with our Services and representatives. For example, if you interact with us online, over the phone, via mail, or email, we will collect and maintain records of your interactions, including through telephone records, voicemails, emails, chat histories, and messaging histories. 

Professional Information. On occasion we may collect information about your work and education history, such as when you apply for a position as a workforce member or when such collection is relevant to our business purposes. 

Posted Content. We may offer individuals the ability to post content publicly (to users of our Online Services, members of our communities, or others) that others can view (e.g., comments or feedback). If your content is posted to the general public or in a limited public forum, it will be visible to others. As a result, we caution you to refrain from posting any private or sensitive personal information and to not assume that your post will be anonymous. We will remove or edit posted content at our own discretion or if we are required by law to do so. 

Survey data. We may contact some individuals to request participation in a survey or other general research. If you choose to take part in these, you may provide personal information, in or along with your survey responses, or in any other feedback or comments you give us. 

Contests, sweepstakes, and prize drawings data. If you take part in a contest, sweepstakes, or prize drawing, then you may provide personal information, feedback, or comments to enter, or as part of the contest, sweepstakes, or prize drawing.

Chat Modules. We may collect certain categories of personal information from you when you use interactive chat modules on the Websites. By interacting with the chat module, you consent to our collection practices and understand and acknowledge that we may use this data to communicate with you about our products and services.

The following are examples of contexts in which you may provide personal information directly to us. 

Informational Requests. When you request information about Rolus, our marketing partners, or our Services, we collect personal information you provide regarding this request. 

Product Purchases and Transactions. We collect personal information to facilitate purchases, payment processing, refunds and exchanges, legal disclosures, updates regarding our Terms and other policies, subscriptions, renewal notices, and other transactions between you and us.

Communications. If you communicate with us in any medium (in person, telephonically, email, text/SMS messaging, etc.) we will collect your contact information and any personal information you provide in the communication. We maintain records of electronic communications. 

Personal Information We Receive From Others

In addition to the personal information we gather automatically and collect directly from you, we collect personal information about you from third parties, including when they deploy tracking technology in our Online Services. Personal information we obtain from third parties includes information collected in the following contexts: 

  • Directed and Authorized Disclosures. If you direct third parties to disclose personal information to us, or if you authorize that we may collect personal information pertaining to you from a third parties, we will collect your personal information from those third parties.
  • Social Media Platforms. We also receive information from you when you interact with our social media pages, groups, accounts or posts. The categories of data we collect include individual users’ public profiles as well as aggregated data about followers on social media (e.g., age, gender and location). We keep track of users’ engagement with our social media pages and the efficacy of our marketing on those platforms. 
  • Other Third Parties. In addition to the aforementioned, the third parties from whom we gather personal information include internet service providers, operating systems and platform providers, data analytics providers, advertising networks, business partners, government entities, our company affiliates, security services providers, our community experience partners, other individuals, social media platforms, and other visitors to our Online Services.

Cookies and Similar Tracking Technologies

Our online properties use Tracking Technologies placed by us and third-party partners and service providers to gather information when you interact with our Online Services. These Tracking Technologies are used to maintain the security of the Online Services, optimize their performance, save your preferences, troubleshoot and repair impairments on the Websites, and assist with functionality. 

Some of the Tracking Technologies used by us and our third-party partners and service providers are used for analytics and marketing purposes. For example, we use Data Gathering Technologies to collect user information for analytics purposes, to identify users across sites and contexts in order to serve advertisements, to manage and display ads in a coherent way, to tailor ads to your preferences and interests, and to measure the effectiveness of our marketing. Advertising partner and services providers use information collected from your activity on our Online Services to inform you about products and services tailored to your interests. These advertisements may appear either on our Websites or others.

Some browsers include a "Do Not Track" setting that can send a signal to the websites you visit indicating you do not wish to be tracked. Our websites do not respond to browser Do Not Track signals. How We Use Personal Information

We may use your personal information for a variety of reasons. Depending on how you interact with our Services, these include using personal information: 

  • To deliver our Services (including our Online Services) to you and to secure and improve them.
  • To validate your identity as necessary to ensure the security of our Services and systems.
  • To send you important information, such as information about your transactional interactions with us. 
  • To send you marketing and promotional communications. 
  • To facilitate communications. 
  • To respond to your requests related to our Services.
  • To maintain and improve the security and performance of our Services. 
  • To anonymize, aggregate, or de-identify your personal information (so it can no longer identify you) in furtherance of conducting research and analysis.
  • To make strategic decisions concerning our business operations.
  • To deliver targeted advertising and to measure its effectiveness.
  • To determine the effectiveness of promotional campaigns.
  • To enforce, and review compliance with, the legal terms that govern our offerings in furtherance of our legitimate interest in ensuring adherence to the relevant terms.
  • To comply with our legal obligations under applicable laws.
  • To protect the rights, safety, and property of Rolus, our users, and third parties.
  • In any other way we may describe when you provide the information.
  • For any additional purpose, in which case we will notify you before we use it for such purpose. 

Your failure to provide personal information in certain contexts may prevent us from completing a transaction with you or providing a good or service you request. 

Disclosure of Personal Information

In relation to the use of your personal information, we disclose, share, or otherwise make available personal information to other entities, including with the following:

Business Services Providers. These are persons or entities with whom we have a relationship to provide business operations services and support to Rolus. These providers may include the following:

  • IT Operations Providers. These include cloud computing service providers, internet service providers, data backup and security providers, functionality and infrastructure providers, and similar service providers. These parties include entities like Shopify and Hubspot. 
  • Operations Providers. These include service provider with whom we partner to provide day-to-day business operations, including payment processors, security vendors, business software service providers, logistics providers, banks, delivery and shipping providers and similar entities. 
  • Professional Service Providers. These include lawyers, accountants, consultants, security professionals, and other similar parties when disclosure is reasonably necessary to comply with our legal and contractual obligations, prevent or respond to fraud or abuse, defend ourselves against attacks, or protect the rights, property, and safety of us, our customers, and the public.

Marketing and Advertising Providers. These include advertising, direct marketing, and lead generation providers, affiliate marketing program providers, retargeting platforms, data brokers, ad networks, marketing consultants, and similar services providers. 

Legally Required Parties. Persons to whom we are required by law to provide information, such as pursuant to a subpoena or a court order.

Reorganization. Persons involved in the consideration, negotiation, completion of a business transaction, including the sale, merger, consolidation, acquisition, change in control, transfer of substantial assets, bankruptcy, or reorganization, and any subsequent integration.

Authorized Disclosures: To any party when authorized by the individual to whom it pertains to share it. 

Retention of Personal Information

We will retain your personal information only for so long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure of your personal information; the purposes for which we process your personal information and whether we can achieve those purposes through other means; and the applicable legal requirements. In some circumstances, you may ask us to delete your information. Additionally, we may anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. 

Security

We have implemented and maintain reasonable security procedures and practices, appropriate to the nature of the information, to protect your personal information from unauthorized access, destruction, use, modification, or disclosure. However, no security measure is perfect, so we cannot guarantee the security of your personal information. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply common protections described in this policy.

International Data Transfers

Rolus is located and operates in the United States. By submitting personal information to us, you understand that we may transfer your personal information to countries foreign to you, including the United States, for processing. The laws that apply to the use and protection of personal information in the United States, or other countries or jurisdictions in which we transfer or process personal information, may be different from the laws and protections in your country. These transfers may include transfers to our service providers located in foreign jurisdictions. Whenever we engage a service provider, we require that its privacy and security standards adhere our requirements and applicable privacy laws.

You can control the collection and use of personal information for some of our processing activities. This includes: 

Adjusting Communication Preferences

Email: You may unsubscribe from promotional and other types of communications by following the “unsubscribe” instructions near the bottom of the email. You may also email us at support@rolus.com. Please note, opting out of promotional emails will not stop you from receiving all emails from the company. For example, we may still send you emails pertaining to your purchases, registrations, consumer surveys and similar transactions. 

Text Messages: You may opt out of automated text notifications any time by replying “STOP,” or any alternative keyword we have shared with you.

Mail Promotions: You may ask us to unsubscribe from our mail promotions and solicitations by emailing us at support@rolus.com.

Controlling Cookies. Most web browsers automatically accept cookies by default, but you can alter how your browser responds to cookies by adjusting the settings. Information about managing cookies for popular web browsers can be found in the links below:

Email Web Beacons. Email web beacons provide information about your interaction with emails we send, such as if and when you opened them. Most email clients have settings to prevent the automatic downloading of images (which includes web beacons) which will prevent the automatic connection to servers hosting those images.

Blocking Google Analytics. To opt out of Google Analytics data collection, follow these instructions from Google. To learn more about how Google uses personal information visit: www.google.com/policies/privacy/partners/. 

The Meta Pixel. Our websites use the Meta (Facebook) Pixel and related cookies set by Facebook. Where required by law, we enable Limited Data Use to limit how Meta uses information about individuals. 

Interest Based Ads Preferences. For more information about interest-based ads, or to opt out of having your web browsing information used for interest-based advertising purposes, please visit Your Ad Choices and Manage My Browser’s Opt-Outs. Your device may also include a feature (“Limit Ad Tracking” on iOS or “Opt Out of Interest-Based Ads” or “Opt Out of Ads Personalization” or “Opt Out of Interest-Based Ads” on Android) that allows you to opt out of having certain information collected through apps used for behavioral advertising purposes. If you opt-out, you will still receive advertisements, but they will not be delivered to you by such companies from whom you have opted-out based upon your behavioral data possessed by the companies from whom you have opted-out. Cookie-based opt-outs are not effective on certain mobile services. Users may opt-out of certain advertisements on mobile applications or reset advertising identifiers via their device settings. 

Your Privacy Rights

Some jurisdictions provide covered individuals with specific privacy rights which can be exercised against covered entities. Depending on the jurisdiction, these rights may include the following: 

  • Access and Portability. The right to know (or confirm) what personal information a business has collected about you, and to receive a copy of it. 
  • Deletion/Restriction. The right to request that a business delete personal information it has collected from you or restrict how it is used, subject to certain exceptions.
  • Correction/Rectification. The right to request correction of inaccurate personal information maintained by the business. 
  • Opt-Out of the Sale/Sharing of Your Personal Information. The right to opt-out of the sale of your personal information to third parties. The term “sale” varies by jurisdiction, but sometimes includes the right to opt-out of the use of personal information for targeted advertising purposes.
  • Revoke Consent. Where consent is required for processing under applicable law, you may withdraw your consent to the processing of your information at any time. 
  • Object to Processing. You may object, on grounds relating to your situation, to our processing of personal data concerning you which is (i) necessary for the performance of a task carried out in the public interest, (ii) carried out in the exercise of official authority vested in us, or (iii) processed by us on the basis of our legitimate interest. In this case, where applicable, we will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
  • Limitation/Restriction. The right to limit or restrict a business’s use or disclosure of certain personal information.
  • Opt-out of Profiling/Automated Decision-Making: The right to opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. 
  • Non-Discrimination. The right not to be discriminated against for exercising any of the rights conferred at law.
  • Complaints. The right to lodge a complaint with the appropriate governmental authority.

Rolus will honor the privacy rights afforded to individuals in accordance with applicable law and will not discriminate against individuals for exercising their privacy choices under the law. Please note: Rolus is a small but growing brand that is not subject to all of the data privacy laws applicable to larger entities in the United States. However, we make efforts to honor the privacy requests of our customers and visitors to the extent we are able, and as required by applicable law. 

Exercising Your Privacy Rights

You may make a request at any time to exercise your access, deletion, correction, and restriction rights listed above by emailing us at support@rolus.com. We will respond to your request within a reasonable period (if properly submitted) and in accordance with applicable law. If we need more time to process and respond to your request, we will notify you of that fact along with the reason for the delay. If we decline to act regarding your request, we will inform you of our decision and the reason for it, and, if applicable, with instructions on how you may appeal our decision. 

Jurisdiction-Specific Privacy Disclosures

Additional Notice to California Residents

Businesses of a certain size and/or business that gather and use personal information about a large number of California residents are subject to the California Consumer Privacy Act (the “CCPA”). As of the Effective Date, we are not subject to the CCPA based on the applicable metrics. Nevertheless, we take efforts to ensure the privacy of personal information of California residents, including taking the measures described in this Privacy Policy. 

California Shine the Light Disclosures. California Civil Code Section 1798.83 permits visitors to our Sites and users of our Services who are California residents to request, once a year, certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make a request, please send us an email at support@rolus.com and include “Shine the Light Request” in the subject line.

Notice of Financial Incentive. We may offer our customers loyalty and other incentive programs that provides certain benefits, such as rewards and exclusive offers. We may also provide other promotional campaigns, such as sweepstakes, contests, or limited-time promotions (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under the CCPA. The value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants. Participation in a Program is governed by the applicable terms and conditions (including the Official Rules for any sweepstakes or contest or the promotional terms for any short-term promotion), which will also describe the financial incentives associated with the promotion and how to participate. You are not obligated to participate in any contest, sweepstakes, or short-term promotion and may terminate your participation at any time (as described in the Program terms and conditions). You may withdraw from participating in a Program at any time by contacting us using the designated method set forth in the applicable Program terms and conditions.

Additional Notice to Residents of Virginia, Colorado, and Connecticut

Rolus is not yet subject to the comprehensive privacy laws applicable in Colorado, Connecticut, and Virginia. Nevertheless, we take efforts to ensure the privacy of personal information of residents of those states, including taking the measures described in this Privacy Policy.

Additional Notice for Nevada Residents

You have the right to direct us not to sell certain personally identifiable information that we collect about you on the Websites by emailing us at support@rolus.com. This information includes: your first name or first initial and last name in combination with your social security number; driver’s license number, driver authorization card number or identification card number; account number, credit card number or debit card number, in combination with any required security code, access code or password that would permit access to your financial account; medical identification number or a health insurance identification number; user name, unique identifier or electronic mail address in combination with a password, access code or security question and answer that would permit access to an online account.
